CDP Files Amicus Brief in California Anti-SLAPP Case

CDP filed a friend-of-the-court brief yesterday in support of an appeal by Direct Action Everywhere, an animal rights group, in a case involving protest at a horse-racing track.

Focusing on a ruling by the trial court that anomalously interpreted the California anti-SLAPP statute — which, if upheld, would seriously hobble the statute, one of the nation’s strongest anti-SLAPP laws — the brief explains why the trial court ruling runs contrary to legislative intent, prior case law, and prevailing views in states with similar anti-SLAPP statutes.

Amazon Watch, the Civil Liberties Defense Center, the Mosquito Fleet, Portland Rising Tide, and the Sierra Club signed the brief in addition to CDP.
